These general terms of use (hereinafter, GTU) regulate access to and use of the Website under the

hereinafter TERA, with Tax ID No. B09963935, located at C/ MISTRAL, 3, 03006 ALICANTE

2. PURPOSE.
These General Terms of Use (hereinafter, “GTU”) regulate access to, browsing, and
use of the Website accessible via the domain https://terabatteries.com/, as well as the
liabilities arising from the use of its contents, understood as texts, graphics,
drawings, designs, codes, software, photographs, music, videos, sounds, databases, images,
expressions, and information, as well as any other creation protected by national laws and
international treaties on intellectual and industrial property.
The primary purpose of the Website is to offer corporate information about TERA, as well as to allow
direct contact with the company through forms.
Access to the Website by the User is free of charge, without prejudice to the fact that the
use of certain services may require prior registration or the contracting of specific services,
which will be subject to their own contracting or booking terms.
The use of the Website grants the status of User and implies full and unreserved acceptance
of each and every provision included in these GTU in the version published
at the time of access. Therefore, if you do not agree with any of the clauses set forth
herein, you must refrain from using this Website.
TERA reserves the right to modify the GTU without prior notice and at any time. Likewise,
TERA reserves the right to suspend, interrupt, or cease operating the Website at any time. Consequently,

By “use of the Website”, it is understood any User who accesses and browses the Website
regardless of whether they complete contact forms, registration, sign up as a user, subscription,
incidents, or post comments, among the functions that can be carried out on the Website.

The User undertakes to comply with the GTU, as well as to comply with the special warnings
or instructions contained on the Website and to act always in accordance with the law, good customs, and the
requirements of good faith, exercising maximum diligence taking into account the nature and
consideration of the service enjoyed. To this end, they shall refrain from using the Website in any
way that may prevent, damage, or impair its normal operation, the goods or rights
of TERA, its suppliers, its distributors, other Users, or in general any third party.
Specifically, and without implying any restriction on the obligation assumed by the User
in general in accordance with the preceding section, the User undertakes in the
use of the Website:
To use the Website for unlawful or illegal purposes, or those contrary to the provisions of these GTU, to good faith, and
to public order.
Not to introduce, store, or disseminate on or from the Website any information or material that is
defamatory, libelous, obscene, threatening, xenophobic, pornographic, advocating terrorism,
inciting violence, discrimination based on race, sex, ideology, religion, or that in any way
violates public order, fundamental rights, public liberties,
honor, privacy, or the image of third parties and in general current regulations.
Not to introduce, store, or disseminate through the Website any computer program, data, virus,
code, or any other electronic or physical instrument or device susceptible to causing
damage to the Website, to any of the services, or to any of the equipment, systems, or networks
of TERA, of any User, of TERA’s Suppliers or Distributors, or in general of
any third party, capable of causing any type of alteration or preventing their normal operation.
To refrain from impersonating other users, providing false or inaccurate data, or performing
any action that may mislead regarding the identity of the user.
Not to introduce, store, or disseminate through the Website any content that infringes intellectual,
industrial property, or third-party rights, nor in general any content of
which they do not hold, in accordance with the law, the right to make available to third parties.
To refrain from reproducing, copying, distributing, making available, or in any other way publicly communicating
the contents of the Website without the express authorization of the holder of the corresponding rights.
To refrain from performing acts of spamming, unauthorized advertising, or mass email sending through
the forms on the Website.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

(hereinafter, the “Contents”), as well as trademarks, trade names, or other distinctive signs, are the
exclusive property of TERA or third parties who have authorized their use, all being
protected by intellectual and industrial property legislation.
In no case shall it be understood that any license is granted or that a waiver, transfer, or
total or partial assignment of said rights is made, nor is any right conferred, in particular, of alteration, exploitation,
reproduction, distribution, or public communication regarding said Contents without the prior
express written authorization of TERA or the corresponding owners.
The User may only access, view, and use the Contents for their personal and
private use, prohibited from using them for commercial or professional purposes, as well as their modification,
copying, alteration, reproduction, adaptation, or translation, total or partial, without the express authorization of the
owners of such rights.
Failure to comply with the provisions of this clause may give rise to the exercise of corresponding
legal actions in defense of the rights of TERA and, where appropriate, of the legitimate owners of
intellectual and industrial property rights.
Through these GTU, no intellectual or industrial property rights over the Website or any
of its component elements are assigned, with the reproduction, transformation, distribution,
public communication, making available, extraction, reuse, resending, or use of any nature, by any
means or procedure, of any of them being expressly prohibited to the User,
except in cases where legally permitted or authorized by the holder of the
corresponding rights.

5. EXCLUSION OF WARRANTIES AND LIABILITY.
5.1. Exclusion of Warranties and Liability for the Operation of the Website.

TERA does not guarantee the availability and continuity of the operation of the Website or of the services or
Contents offered therein, nor that the content on the Website is updated. Consequently,
it shall not in any case be liable for damages and losses of any nature that
may arise from:

tasks aimed at rectifying errors, re-establishing communication, and/or updating said

Likewise, TERA guarantees neither the technical reliability of its Website nor access to its various pages,
being similarly exempted from all liability for damages of any
nature that may arise from this cause.
Furthermore, TERA is not responsible for possible security errors or deficiencies that could
occur due to the User’s use of an outdated or insecure version of a
browser, or for damages, errors, or inaccuracies that may arise from
its malfunction.
Although TERA adopts appropriate technical and organizational security measures to protect the
Website, it does not guarantee the absence of viruses or other elements that may cause alterations in the
computer system (software and hardware) of the User or in the electronic documents and files
stored on their system.
Consequently, TERA shall not be liable for any damages produced
by the presence of viruses or other harmful elements.

TERA shall under no circumstances be responsible for the use that users or third parties may make of the Website

In particular, TERA shall not be liable for damages that may derive from:

links, banners, buttons), directories, and search tools that allow access to websites
belonging to and/or managed by third parties.
TERA does not offer or market, by itself or through third parties, the products and/or services
available on such linked sites, nor does it assume any liability for the information contained in
them, or for damages that may derive from access to them.

5.4. Exclusion of liability for User conduct.
TERA shall not be liable for damages of any nature derived from the use that
Users make of the Website, as well as of the Contents or services offered in
it, in breach of these GTU or the law.

6. HYPERLINKS.
Those persons intending to establish hyperlinks between their webpage and the Website shall
observe and comply with the following conditions:
Prior authorization shall not be required when the Hyperlink only allows access to the
homepage of the Website, but it may not reproduce it in any way. Any other form of
Hyperlink shall require express and unequivocal written authorization from TERA.

TERA reserves the right to block Hyperlinks directed to the Website that do not have
prior express authorization even if they comply with the provisions of this section of the
General Terms.

7. ACTIONS IN CASE OF NON-COMPLIANCE.
TERA reserves the right to exercise all actions available under the law to enforce the
liabilities arising from the breach of any of the provisions of these GTU by
the User.

8. SEVERABILITY.
The declaration of any of the clauses contained in these GTU as null, invalid, or ineffective shall not
affect the validity or effectiveness of the remaining ones, which shall continue to be binding between the parties.

9. PRIVACY AND COOKIES POLICY:
The processing of personal data is regulated in the Privacy Policy and the installation of cookies in the
Cookies Policy, both available on the Website.

10. NOTIFICATIONS.
For the purposes of serving appropriate notifications, TERA designates as its contact address the
one specified in the Legal Notice.
The email address provided by the User during the registration process on the Website,
if any registration exists, shall be used by TERA for the purpose of serving notifications to the User.
The User is obligated to keep the data referenced in this clause properly updated for
notification purposes.
All Notifications made by TERA to the User shall be considered validly made
if carried out using the data and through the means indicated above. TERA is not
responsible for any damage that may occur due to the User’s breach of their obligation
to keep their contact details updated.

11. APPLICABLE LAW AND JURISDICTION.
These GTU shall be governed by the provisions of Spanish law.
Any dispute regarding the conditions of use and access to this Website contained in this
GTU document shall be submitted by the parties, expressly waiving any other jurisdiction that
may correspond to them, unless otherwise determined by legal imperative, to the corresponding Courts.
