1. GENERAL INFORMATION

These Terms and Conditions (hereinafter the “ T&C ”) apply to registration in the TERA BATTERIES RECYCLING, SL, workshop network (with registered office at C/ Mistral 3 – Poligono Industrial Pla De La Vallonga 03006 – (Alicante) and NIF B09963935). Hereinafter the “ TERA Workshop Network ”.

From now on, TERA BATTERIES RECYCLING, SL will be referred to for the purposes of these T&C as “ TERA ”, “ Company” or “ Us ”, and you will be referred to as “ You ” or the “ Workshop ”.

By registering in the TERA Workshop Network by sending the registration form, you are accepting each and every one of the T&C. If you do not agree with any of the T&C, do not send the registration form.

2. MODIFICATION AND UPDATE OF THE T&C

The Company may change, update, add or remove provisions of these T&C by posting the updated T&C on its website at any time.

3. LEGAL REQUIREMENTS FOR REGISTERING IN THE TERA WORKSHOPS NETWORK.

 By submitting the registration form in the TERA Workshop Network, you declare, acknowledge and accept that you are at least 18 years of age and that you have the legal capacity to enter into contracts. You also declare that you are a company or professional who owns a legally established and operating vehicle workshop and that you have the necessary licenses and authorizations to operate as an automobile workshop. For operational reasons, registration in the TERA Workshop Network will only be possible for workshops located in Spain.

An essential and exclusive requirement, if not fulfilled by the workshop, to be included in our list of locations, is that the workshop must have the capacity to determine in advance whether the fault is in the battery. To do this, it is necessary for the workshop to have a diagnostic machine that can detect the fault in the vehicle’s battery. This diagnostic machine must be considered suitable by TERA according to its own criteria.

By submitting the form, the Workshop declares that registering in the TERA Workshop Network does not imply any incompatibility or breach of any agreement it may have signed with any third party.

All information you provide when submitting the form must be accurate, true, complete and current. You may change, correct or delete any information you have provided incorrectly by sending an email to info@terabatteries.com.

You agree to indemnify and hold the Company harmless if the information provided or the statements included in this clause are false, inaccurate or incomplete.

4. BENEFITS OF REGISTERING IN THE TERA WORKSHOPS NETWORK.

Visibility . By submitting the registration form you will have greater online visibility as our users will be able to search for you through our website. By submitting the form you authorize the Company to include your workshop details in the workshop search engine included on the TERA website and specifically authorize the publication of the following information about your workshop: name of the workshop, location and telephone number.

Free of charge. Signing up to the TERA Workshop Network does not entail the payment of any kind of fee or commission. It is completely free of charge.

No commitment to remain: You can unsubscribe from the TERA Workshop Network at any time by simply sending an email to info@terabatteries.com , and within a maximum period of 3 days your workshop will be removed from the search engine.

Recommendation : If any of our clients or users ask us for a workshop, we recommend that they go to the search engine on our website. We also expect that if any client or user of your website needs to carry out any repair or action on their electric vehicle battery, you direct them to our website and provide them with our contact details.

Possibility of being a TERA collaborating workshop: After sending the form, you authorize us to contact you to offer you the possibility of becoming part of the TERA network of collaborators, which will allow you to formalize a contractual relationship with us and place service orders through the TERA website.   

5. INDEPENDENCE.

Registration or enrollment in the Workshop Network or anything in these T&C shall not be construed as the formalization of a contract, nor the creation of an association, joint venture, and/or an agency relationship or any other.

6. INTELLECTUAL PROPERTY

All information and content provided through our website, including documents, services, site design, text, graphics, logos, images and icons, logos and trademarks, as well as the arrangement thereof, are the exclusive property of TERA or its licensors and you may not use them in any way. These T&C do not constitute any transfer of license of our intellectual property rights, so you may not use our logo, trademark, trade name or any intellectual property rights of TERA or its licensors, nor claim the existence of any relationship or connection with TERA. Except as otherwise required or restricted by applicable law, any reproduction, distribution, modification, retransmission or publication of any copyrighted material is strictly prohibited without the express written consent of the copyright owner or the licensee.

7. UNAUTHORIZED ACTIVITIES.

By submitting the form you agree to:

• Do not defame or otherwise cause material or reputational damage to TERA.
• Do not provide TERA confidential information that you may have access to if you become a TERA partner workshop to any third party, or use it for your own benefit or that of a third party.
• Do not post information related to our business or Services.
• Do not post anything that is contrary to our public image or that may damage TERA’s reputation.

This list of prohibitions provides examples and is neither complete nor exclusive, TERA hopes that you will always act in good faith.

8. WITHDRAWAL FROM THE TERA WORKSHOP NETWORK.

Without prejudice to the Workshop’s possibility of unsubscribing at any time from the TERA Workshop Network, We may at any time unsubscribe and remove you from the search engine if you provide false or incomplete information or if we detect any action on your part that may damage the image or business of TERA, all of this without prejudice to being able to exercise the actions that assist us legally if your action causes damage to TERA, including reputational damage.

9. DISCLAIMER.

TERA shall not be liable to you for any damages arising from users of the TERA website who find you through the search engine, including non-payment for services that they may contract with you after having located you on our website.

10. WRITTEN COMMUNICATIONS AND NOTIFICATIONS

The Workshop may send notifications and/or communicate with the Company via email at info@terabatteries.com and, where applicable, through the contact spaces on our website.

Likewise, you authorize TERA to contact and/or notify the Workshop at the email and/or telephone number provided in the registration form.

11. NULLITY

If any of these T&Cs were declared null and void by a final decision issued by a competent authority, the remaining clauses will remain in force, without being affected by said declaration of nullity.

12. COMPLETE AGREEMENT

These T&C constitute the entire agreement between TERA and you in relation to the TERA Workshop Network.

13. DATA PROTECTION

The information or personal data that the Workshop provides to TERA during registration will be treated in accordance with the privacy policy included on our website. By accessing, browsing and/or using our website and sending the form, you consent to the processing of said information and data and declare that all the information or data you provide is true.

14. APPLICABLE LEGISLATION AND JURISDICTION

Any controversy, problem or disagreement that arises or is related to the interpretation and execution of these T&C will be subject to the jurisdiction of the courts and tribunals of Alicante (Spain), unless the legislation establishes another jurisdiction in an imperative manner.
